Individual entrepreneur Ovsep Valerievich Osipyan (OGRNIP 313230833000053, INN 230817678292), address: apt. 27, 1B im. R. Mazhatova str., stanitsa Shelkovskaya, Shelkovskoy district, Chechen Republic, 366108, Russia (the “Provider”), providing services through the HiForward service available at hi-forward.com (the “Service”), hereby informs customers of the following.

1. Purpose of this document

1.1. This Policy is informational. It explains the conditions under which international delivery services are arranged and why, in respect of certain items, destinations and operations, the provision of services may be impossible.

1.2. This Policy does not establish independent restrictions introduced by the Provider at its own discretion and does not provide for refusal of service on the grounds of a customer nationality, place of residence or place of establishment.

1.3. This Policy supplements the Service Agreement (public offer) and the Service Rules published in the Service and does not replace them.

2. How the services are arranged

2.1. Delivery services are arranged with the involvement of third parties: warehouse operators, carriers, parties performing customs operations and other contractors. Shipments cannot be moved without their involvement.

2.2. Each such party operates in the territory of the relevant state and is subject to the laws of its country of establishment and to the rules applicable to its type of activity. Such requirements include, in particular, export control requirements, requirements applicable to the movement of military and dual-use items, and restrictive measures applicable to certain persons, goods and territories.

2.3. The parties involved determine independently which cargo they accept for handling and carriage and may refuse to accept, detain, return or withhold a shipment where this follows from the requirements applicable to them. The Provider cannot compel such parties to act otherwise.

2.4. In addition, decisions on release, detention, seizure or return of shipments are taken by the authorities of the country of dispatch, transit and destination. Such decisions are taken beyond the control of the Provider and the customer.

3. What this means for the Customer

3.1. The Customer understands and accepts that the range of items, destinations and operations available for the provision of services is determined not by the discretion of the Provider but by the combination of requirements applicable to the parties involved and to the movement of shipments.

3.2. For these reasons, the acceptance, carriage and delivery of certain categories of items, as well as delivery to certain territories, may be unavailable or discontinued, including after an order has been placed. Current information on available destinations and on prohibited and restricted items is published in the Service Rules and may change.

3.3. The Customer understands and accepts that the requirements applicable to the parties involved change independently of the Provider, and that this Policy and the Service Rules may therefore be amended at any time by publishing a new version in the Service.

3.4. The impossibility of providing services on the grounds set out in this Policy does not constitute a breach of the Provider obligations. Settlements in such cases are made in accordance with the Service Agreement.

4. Information provided by the Customer

4.1. In order for a shipment to be accepted by the parties involved and processed in the established manner, the Customer confirms, upon placing each order, that: the contents are not items prohibited from export from the country of dispatch, from transit or from import into the country of destination; the contents are not military items, dual-use items or other items whose movement requires authorisations or licences, and where such authorisations are required, that they have been obtained and can be produced upon request; neither the Customer, nor the recipient, nor the end user of the contents is a person subject to restrictive measures applicable to the relevant operation; the information on the contents, their value, the Customer, the recipient and the end user is complete, accurate and correct.

4.2. These confirmations are required by the Provider in order to pass information to the parties involved and to prepare documents in respect of the shipment. The Provider does not carry out an independent legal classification of the contents and relies on the information provided by the Customer.

4.3. Before placing an order, the Customer is advised to review the restrictions applicable to the movement of the relevant goods between the countries of dispatch and destination, as well as the list of prohibited and restricted items published in the Service Rules.

5. Requests for information and suspension

5.1. The parties involved and public authorities may request additional information and documents concerning a shipment, its contents, the Customer, the recipient and the end user. Such requests are forwarded to the Customer through the personal account.

5.2. Pending receipt of the requested information, the provision of services in respect of the relevant shipment may be suspended. The period of suspension is not included in service timeframes.

5.3. If the requested information is not provided, or if it follows from the information provided that the contents cannot be moved in accordance with the requirements applicable to the parties involved, the contents are not dispatched. The Customer may dispose of such contents in the manner provided for by the Service Agreement.

5.4. The Provider may withhold the substance of the requirements and the grounds for decisions taken to the extent that disclosure is restricted by applicable law or by the terms of engagement with the parties involved.

6. Consequences of inaccurate information

6.1. Where information provided by the Customer proves inaccurate and this results in measures being applied to the shipment, to the Provider or to the parties involved, the Customer shall compensate the Provider for the resulting losses, costs and expenses, including amounts of claims, fines and other sanctions. This obligation applies irrespective of any breach of obligations and survives termination of the contract.

6.2. The procedure for compensation and the limits of liability of the parties are determined by the Service Agreement.

7. Final provisions

7.1. This Policy is published in Russian and English. In the event of any discrepancy, the Russian version prevails unless applicable law provides otherwise.

7.2. The current version of this Policy is published in the Service.
